To the extent permitted by applicable law, the total liability of Genesis Global School / KSC Educational Society to the User for any claim arising in connection with the Website shall be limited to the amount, if any, actually paid by the User to Genesis Global School / KSC Educational Society in relation to the specific transaction giving rise to such claim.

Disclaimer of Consequential Damages

To the maximum extent permitted by applicable law, Genesis Global School, KSC Educational Society and any parties, organisations or entities associated with the School shall not be liable for any damages whatsoever, including without limitation incidental, indirect or consequential damages, loss of profits, loss of data, damage to computer hardware or business interruption, arising from the use of or inability to use the Website or any Website material.

Such liability shall be excluded irrespective of whether the claim is based on warranty, contract, tort or any other legal theory and whether or not Genesis Global School or KSC Educational Society has been advised of the possibility of such damages.

Transaction Fees and Refunds

Where applicable:

  • Transaction fees charged by a payment gateway or financial institution may not be refundable or reversible in cases of refund, reversal, chargeback or for any other reason, subject to the applicable terms of the payment gateway and the School.
  • Any transaction or payment processing fee charged in connection with a payment may be borne by the User / cardholder, as applicable.
  • School fees and other payments once made shall be governed by the applicable fee structure, payment terms, refund policy and rules of Genesis Global School / KSC Educational Society.
  • Any refund, where applicable, shall be processed in accordance with the School’s prevailing policies and applicable laws.
  • Activity fees and other programme-specific payments, where applicable, may be subject to separate payment terms and refund conditions communicated by the School for the relevant activity or programme.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the applicable laws of India.

Any dispute arising in relation to these Terms and Conditions or the use of this Website shall be subject to the jurisdiction of the appropriate courts having jurisdiction over Noida, Uttar Pradesh, subject to applicable law.

Changes to These Terms and Conditions

The School may review these terms and conditions periodically to ensure that it remains consistent with applicable law, regulatory requirements and the operational requirements of the School.

  • any other competent statutory, regulatory or educational authority; or

In case of any inconsistency between these Terms and Conditions and a mandatory provision of law, the applicable law shall prevail.
